USCIS Immigration Fees Increase

Unfortunately, the USCIS fees increase is not just a cruel April Fool’s joke.  The new USCIS fees go into effect today, April 1, 2024, and is the first adjustment since 2016.

Some of the key changes in the fee schedule include the following:

Family-Based Immigration Petitions:

Form

  • I-130 – Petition for a foreign relative

    • $625 (online)

    • $675 (paper)

  • I-485 – Application to Register for Permanent Residence or Adjustment of Status

    • $950 for children under the age of 14 who submit the form with their parents;

    • $1,440 for independent application (now includes biometric fee)

  • I-765 – Application for Employment Authorization, next to I-485

    • $260 when filed with an adjustment of status

  • I-131 – Application for Travel Document

    • $630 if filed with an adjustment of status

  • I-130 + Adjustment of Status + Work and Travel Permits

    • $,3005

  • I-29F or K-1 Fiancé Visa

    • $675

  • N-400, naturalization application

    • $710 (online);

    • $760 (paper)

Employment-Based Applications:

 Form

  • I-129 – Petition for Nonimmigrant Worker

    • $780

  • I-140 – Immigrant Petition for Foreign Immigrant Worker

    • $715

  • I-907 – Request for Premium Processing

    • $2,805

  • I-526 – Immigrant Petition by Independent Investor or EB-5 Program

    • $11,160

  • H-2A

    • $1,090

  • H-2B

    • $1,080

  • L-1A and L-1B

    • $1,385

    • $1,055

What other changes should I know?

Fees

For Temporary Protected Status (TPS) and EOIR filings, there will be a separate biometric fee, reduced from $85 to $30.  Additionally, for Asylum (forms I-129 and I-140 applications) will be $600 but a $300 discount will apply for small employers.  The I-485 filing fee no longer includes the cost of Forms I-765 and I-131 because they are not separate charges.  Further, the H1B cap registration fee will increase from $10 to $215 per registration, which will come into effect for the fiscal year 2026.  Finally, ACWIA, Fraud Detection and Prevention, and Public Law 114-113 fees are still due.
