Who is eligible for Temporary Protected Status?

Temporary Protected Status (“TPS”) can be provided to individuals from certain countries experiencing either an environmental disaster, an ongoing armed conflict, or an extraordinary and temporary condition that prevents individuals to return home safely. 

As of right now, you may be granted TPS if you are from any of the following countries: Afghanistan, Burma (Myanmar), Cameroon, Ethiopia, El Salvador, Haiti, Honduras, Nepal, Nicaragua, Somalia, South Sudan, Sudan, Syria, Ukraine, Venezuela, and Yemen.

What benefits does TPS provide?

Although TPS itself is not a pathway to residency, individuals with TPS cannot be detained by the Department of Homeland Security (“DHS”) on the basis of their immigration status. Additionally, TPS beneficiaries can apply for nonimmigrant status, file for adjustment of status based on an immigration petition, or apply for any other immigrant benefit or protection that they may be eligible.  Second, TPS beneficiaries are able to work legally in the United States with an Employment Authorization Document (“EAD”).  Third, TPS protects individuals from deportation.
